INDIGAL’S TERMS AND CONDITIONS

Terms used:

  • Tenant: Person named in the Confirmation of Booking at Indigal email.
  • Guests: Any persons staying with or visiting the Tenant at Indigal during the time of the Tenant’s booking period.
  • Booking Period:  Any time the Tenant and/or their Guests are on Indigal property, on or around the period of the agreed booking dates.
  1. DEPOSIT of 50% is required to secure the booking. Payment of the rental deposit constitutes the clients acceptance of these Terms and Conditions.
  2. BALANCE of the rental amount must be received in full, 7 days prior to occupancy. If not, the owner has the right to cancel the booking and attempt to re-let it. If paying cash, the full amount outstanding must be paid on arrival, if it's not, the owners reserve the right to charge the full amount (without any discount) to the Tenant’s credit card.  A surcharge applies if paying the balance by credit card.
  3. BOND is payable at the same time as the balance amount. A surcharge applies if paying the bond by credit card. The bond will be refunded between 2 - 21 days after the check-out date and is subject to all the terms and conditions being met. The bond is designed to cover any additional costs incurred, including, but not limited to, any breakage, damage, excess cleaning requirements, extra guests beyond those declared, etc. With breakages, the replacement cost includes, but is not limited to, purchase price, freight, $30/hr search/research fee, installation, outsourcing (eg electricians) etc. Where an item cannot be replace with identical item, the property owners and/or property manager will set a price they consider fair and reasonable. If bond related costs exceeds the bond amount the Tenant will be invoiced and the balance to be paid within 7 days. If a bond issue arises, a $30 processing fee will be charged plus a $50/hr administration fee.
  4. CANCELLATION OF BOOKING by the client: 10% of tariff is non-refundable. The balance, of money paid is refundable if cancellation occurs: outside 60 days of booking; between 60 and 30 days prior to booking 50% of deposit is non-refundable; inside 30 days of booking the deposit is non-refundable unless the house is re-let for the entire period. If a refund is made, due to the property being re-let, a $50 cancellation fee will apply. These terms and fees also apply if changing the booking dates.
  5. PREMISE IS FURNISHED and presented to the property owner’s taste and style and they take no responsibility for any unmet expectations of tenants /guests. This also applies to: any changes made by the owner to the d├ęcor, furnishings and equipment in the premises; expectations from photos of Indigal displayed on Indigal’s website or its listing on Stayz.
  6. ANY CHANGES to the booking must be in writing (emailed) and be received one month prior to your booking date, detailing changes to any of details, eg guest number, guest breakdown of ages, reason for stay, etc. Any change to your booking requires written (emailed) approval. Any deviation from this agreement without prior notification and approval may result in cancellation of your booking and/or loss of bond or part there of. Misleading or false information will result in cancellation of your booking, immediate eviction and/or full loss of bond.
  7. GUEST NUMBERS must not exceed those declared in the  ‘RENTAL AGREEMENT FOR SHORT TERM HOLIDAY LETTING AT INDIGAL’. Changes to guest numbers or adult/child configuration requires written approval. Final guest numbers are required no later than 3 weeks prior to your booking. Changes may be made after this date but require written approval. A $30 administration fee applies to each change.
  8. No refunds are given for guests who don't stay or stay less nights then those confirmed.
  9. NO SMOKING inside the house or in the gypsy wagon.
  10. PARTIES AND FUNCTIONS are strictly prohibited.
  11. NO CANDLES ALLOWED: This includes insect repellent candles and tea lights.
  12. SWIMMING POOL: Pool gate must be kept closed at all times. No glass is to be taken into pool enclosure. Children must be supervised at all times while in pool enclosure.
  13. CHILDREN:
    1. Due to the nature of this property, i.e. unfenced dams, ponds, extensive bushland, swimming pool, etc, children are the full responsibility of their parents and the Tenant.
    2. Disposable nappies must be placed in plastic bags before placing in the bin.
    3. Texters and crayons for children are not permitted at Indigal
  14. PETS: Approval and written permission is required to bring a pet or pets to Indigal. Any damange to house or property, caused by pet/s, must be paid for in full by the Tenant. All pet droppings must be cleaned up from the lawns and parking area in front of and at the back of the house and placed in rubbish bins. Pets are not permitted in the swimming pool, the upstairs bedrooms, or in the baths. Pets are not permitted on any of the beds or furniture.
  15. DISTURBANCE TO NEIGHBOURS - from trespassing or noise (music, yelling, yahooing etc) is prohibited and may result in termination of rental and/or loss of bond. Indigal is visually very private but neighbouring residences are within 50m from the back of the house. Standard noise regulations apply: Noise must be reduced to a minimum at midnight on weekends (Friday and Saturday nights) and at 10pm on week nights (Sunday to Thursday).
  16. MOVING OF FURNITURE, such as lounges, indoor dining tables, plants, etc is not permitted.
  17. TV/SOUND SYSTEMS. The cabling at the back of the TV/Sound systems MUST NOT be touched or changed in any way or under any circumstances. The Tenant will be responsible for costs incurred for retuning/recabling any of these systems that have been changed.
  18. FIREPLACES AND HEATING. Outdoor fireplace: build the fire on the grate in the fireplace only. DO NOT chop wood on fireplace edge or sandstone floor. Use chopping block provided only. Indoor fireplace and gas heater: do not place any item or person on top of or directly in front of fireplace or heater.
  19. REPAIRS, MAINTENANCE OR SERVICE reported and/or requested by the Tenant or deemed necessary by the owners, will be affected as soon as practicable. No recompense will be negotiated due to the failure of any services, equipment or other contents provided at the premises. Tenants are required to allow repair and or service personnel to enter the premises during reasonable hours by arrangement (and at any time in an emergency) for the purpose of conducting any repairs, maintenance or service. Tenants requesting a service call which is subsequently found not to be required will be charged the applicable service call-out fee.
  20. DAMAGE, BREAKAGES, THEFT AND LOSS of Indigal property (including but limited to, the house and its contents, gardens, pool, sculptures/ornaments, etc), and/or the Tenant/Guests property, are the Tenant’s responsibility during their booking period. Any damage, breakage and/or loss to Indigal property is to be reported to the owners/manager immediately. The Tenant is responsible for the full cost of replacement and/or repair of the above mentioned Indigal property along with any incurred administration fees.
  21. INSPECTION: The owners/managers reserve the right to inspect the house without notice if there are concerns of breach of agreed terms and conditions.
  22. DAMS/PONDS: No swimming, jumping or diving into any dams or ponds on the property.
  23. WILDLIFE: Indigal is in a natural bushland setting, much of the acreage is virgin bush. Encounters with wildlife are possible, especially in areas beyond the main grounds. Encounters within the main grounds and house may occasionally occur but are rare. Wildlife includes: frogs, antechinuses, bandicoots, wallabies, goannas, a large variety of birds, etc. Indigal Pty Ltd is released from any responsibility for any unmet expectations or negative encounters.
  24. RUBBISH AND RECYCLING: Wheelie bins are provided at Indigal’s property entrance on The Lakes Way. The unlock wheelie bins mark ‘Indigal’ are for use by the Tenant and their guests. Excess garbage, bottles and boxes which does not fit in the bins must be removed and disposed of by Tenant, or arrangements made with the owners/manager (fees from $30.00 apply). Use of neighbour’s wheelie bin/s is not permitted. A fee of $60/bin will be charged if this occurs.
  25. CHECK-OUT TIME is 10am by the latest unless otherwise arranged and stated in Confirmation of Booking email. If the Tenants or their guests fail to comply with the agreed check-out time, a fee of up to a day’s rent will be charged.
  26. DEPARTURE: The property should be left in a similar state to its condition on arrival. Tenants are to ensure that dishes are washed, dried and put away, floors swept, BBQ cleaned and garbage placed in wheelie bins provided at the property’s front gate, etc. Indigal provides a 7 hour standard clean/maintenance of house and yards after the Tenant and their guests depart. Any cleaning required beyond this is charged to the Tenant at $60/hour.
  27. REFUNDS:  The Bond, and any other refund if required, will be paid to the Tenant by cheque or direct deposit. surcharges apply if the monies are to be refunded into a credit card account.
  28. UNFORESEEN CIRCUMSTANCES.  Indigal Pty Ltd will make every effort to ensure the property is available as booked. However, Indigal Pty Ltd reserves the right to make alterations to bookings due to unforeseen circumstances and a full refund of monies paid will apply.
  29. A SECOND RESIDENCE is on the property and used by the owners/managers. The owners/managers will make every effort to ensure tenant/guest privacy.
  30. It is read, understood and agreed upon that the owners and/or Indigal Pty Ltd shall in no way be held responsible for any debt, damage, loss, cost, delay, expense, injury or inconvenience caused directly or indirectly by events at Indigal. The Tenant hereby agrees that all legal rights for compensation in any form are waived and they take full responsibility for all their guests and visitors during the Tenant’s booking period.
  31. Variations to these conditions may be made only by prior arrangements with the owner/manager in writing.
